These Terms of Service (“Terms”) govern your access to and use of https://apexmeridiangroup.us (the “Site”) and the products and services offered by Apex Meridian Group LLC (“Apex Meridian Group,” “we,” “us,” or “our”). Please read them carefully before using the Site.
1. Acceptance of These Terms
By accessing or using the Site, or by purchasing our products or services, you agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, Payment Policy, Refund & Return Policy, Shipping & Delivery Policy, and Cancellation Policy, each of which is incorporated by reference. The Site displays a consent notice on your first visit, and continued use constitutes acceptance. If you do not agree, please do not use the Site.
2. Who We Are
Apex Meridian Group LLC is an e-commerce and digital marketing company organized under the laws of the State of California, located at 2108 N ST #17050, Sacramento, CA 95816, United States. We provide online advertising, digital marketing services, and online retail offerings.
Apex Meridian Group operates online retail storefronts under their own brand names. Each storefront publishes its own store policies, which govern purchases from that store; the policies on this site set the group-wide standard our storefronts follow.
3. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site or purchase from us. You agree to provide accurate, current, and complete information and to keep it updated. We may refuse service or cancel orders where information appears inaccurate or fraudulent.
4. Use of the Website
You may use the Site only for lawful purposes consistent with these Terms. You agree not to:
- Use the Site for any unlawful, fraudulent, or deceptive purpose;
- Scrape or copy Site content by automated means without our written permission;
- Interfere with or disrupt the Site or its security features;
- Infringe the intellectual property or other rights of Apex Meridian Group or any third party;
- Misrepresent your identity or your affiliation with any person or organization.
5. Orders and Payment
All retail orders are offers to purchase and are subject to our acceptance. We may limit quantities or decline or cancel an order, including where a listing contains a pricing or descriptive error; if we cancel after payment, we will issue a full refund. Prices are stated in US dollars (USD) and are exclusive of sales tax, which is calculated and shown at checkout before you pay. Payment terms, accepted methods, and billing disputes — which must be raised within 60 days of the charge date — are described in our Payment Policy. Orders are normally processed within 1–2 business days and ship with standard US shipping free of charge on every order, with a tracking number provided; shipping is described in our Shipping & Delivery Policy. Returns and refunds, including our 7-day return window from delivery and refunds issued within 7 days of our receiving the returned item, are governed by our Refund & Return Policy. Cancellations are governed by our Cancellation Policy.
6. Services Engagements
Digital marketing and advertising services are typically governed by a separate service agreement, proposal, or statement of work signed by both parties (a “Service Agreement”). If a Service Agreement conflicts with these Terms, it controls for that engagement; these Terms apply to anything it does not address.
7. Intellectual Property
The Site and its content — including text, graphics, logos, and the Apex Meridian Group name and branding — are owned by or licensed to Apex Meridian Group LLC and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent. For services engagements, ownership and licensing of deliverables are defined in the applicable Service Agreement.
8. Third-Party Links and Platforms
Our Site and services may rely on third-party websites and platforms such as advertising networks, marketplaces, and payment processors. We do not control and are not responsible for third-party sites or their policies, and a link does not imply endorsement; your use of third-party platforms is subject to their own terms.
9. Disclaimers
To the fullest extent permitted by law, the Site and our services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Digital marketing outcomes depend on many factors outside our control; we do not guarantee any specific results, rankings, traffic levels, conversion rates, or revenue from marketing or advertising services. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
10. Limitation of Liability and Indemnification
To the fullest extent permitted by law, Apex Meridian Group LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our liability for any retail order is limited to the amount you paid for that order, and our total aggregate liability for claims arising out of or relating to the Site, products, or services will not exceed the amounts you paid to us in the 12 months preceding the event giving rise to the claim. You agree to indemnify Apex Meridian Group LLC and its members, officers, and employees against claims and reasonable expenses (including attorneys’ fees) arising from your violation of these Terms or misuse of the Site.
11. Termination, Governing Law, and General Terms
We may suspend or terminate your access to the Site for conduct that violates these Terms; provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes must be brought exclusively in the state or federal courts located in Sacramento County, California. If any provision is held unenforceable, the rest remain in effect. We may update these Terms; the “Last updated” date above reflects the current version, and continued use after changes constitutes acceptance. These Terms, together with the policies referenced above and any applicable Service Agreement, are the entire agreement between you and us regarding the Site.
